Book Salon General Terms and Conditions for Online Self-Service Booking [04 07 2024]
These General Terms and Conditions (hereinafter “Terms”) shall govern the use of the internet-based online self-service booking system (hereinafter "Booking System”) provided and maintained by Book Salon Oy (Finnish business ID: 2786121-4) (“Book Salon”) to the End Customers and Service Providers.
"End Customer(s)” shall mean the person who books an appointment with the Service Provider through the Booking System and pays for the booking in advance to the Service Provider at the time of booking or pays for the booking to the Service Provider at the time the Service is provided. If Book Salon changes its Booking System so that companies can also book appointments, for example for their employees, the End Customer shall also mean such a company and the actual user of the Service.
“Service Provider(s)” shall mean the third-party company that provides hair, beauty, wellness and other services (hereinafter “Services” or “Service”) to the End Customer and has made its services available for booking through the Booking System to End Customers.
Acceptance of the Terms
By using the Booking System, the End Customer and the Service Provider agree to comply with and be bound by these Terms. If the End Customer or the Service Provider does not agree to comply with these Terms, please stop using the Booking System.
Book Salon is at all times entitled to unilaterally amend these Terms. The latest version of the Terms shall apply within two (2) weeks after the publication. If some of these provisions of the Terms should be invalid, the other provisions shall nonetheless remain valid.
Unless otherwise expressly stated in a document entered into between the relevant parties, in the event of any discrepancy between these Terms and any other document, agreement or terms agreed between Book Salon and the End Customer or the Service Provider and End Customer, these Terms shall prevail.
Terms of Booking the Service
General
The Booking System is designed to provide an online booking platform through the website and mobile app for the Services offered by the Service Providers to the End Customers. The Service Providers independently offer and market themselves and their Services through the Booking System. Book Salon is not a seller or distributor of the Services, but it provides, maintains and markets the Booking System.
Book Salon acts solely as an appointment booking service for the Service Providers’ Services and as a payment intermediary for such Services when a payment transaction for such Service is made through the Booking System. Book Salon does not have control over the Service Providers and the Services they offer. As such, Book Salon is not liable for the quality, safety, legality, or any other aspect of the Services booked through the Booking System.
Book Salon is not bound by the Service Provider’s other terms or any other terms of the Service Providers.
Booking the Services and Booking Confirmation
The Service Provider is responsible for keeping the provided Services, prices, available booking times, contact information and other necessary information in the Booking System up to date.
The End Customer is responsible for providing all requested information while booking the Service(s) through the Booking System and ensuring that the chosen Service(s) and Service Provider are correct. The End Customer should carefully review the information provided by the Service Providers in the Booking System before booking any Service(s).
The booking is always binding. After successfully completed booking, Book Salon will provide the End Customer with a booking confirmation.
The End Customer's obligation is to provide an e-mail address and mobile phone number to which the booking information can be delivered as well as to ensure that any other personal information provided by the End Customer is correct. The End Customer is responsible for checking the spam folder of their email if the booking confirmation is not received after completing the booking.
If the booking confirmation is not received, the End Customer is responsible for contacting the relevant Service Provider to get confirmation that the booking is valid.
If the End Customer presents incorrect, false, or incomplete information, the Booking System may not function correctly and the Services cannot be provided, in which case Book Salon is not bound to fulfil its obligations and the Service Provider is not responsible for providing the Services.
Reschedule and Cancellation Policy
If the End Customer has a cancellation right under applicable mandatory consumer protection law, by booking the Service through the Booking System, the End Customer agrees that the Service may be performed within such cancellation period, provided that the End Customer has booked the Service for such period. At the same time, the End Customer gives his/her prior consent to the fact that the End Customer no longer has the right to cancel the Service after the Service has been performed by the Service Provider, even if the performance of the Service has started within the cancellation period.
The booked appointment can be cancelled or rescheduled without consequences only according to the Service Provider's cancellation policy. The End Customer understands that the Service Provider has the right to charge the price of the booked Service if the cancellation occurs contrary to the terms of the Service Provider's cancellation policy. Book Salon will not give any refunds to the End Customer.
If the End Customer wishes to cancel or reschedule the booking, this must be done at least [●]hours before the start of booked appointment in order to avoid charges relating to late cancellation.
The charges for late cancellation by the End Customer, which will be charged from the End Customer are as follows:
- For cancellations made less than [●] hours before the booked appointment, the End Customer will be charged [●] % of the price of the booked Service. This will also apply to situations where the End Customer does not show up at the booked Service, whether the booking is cancelled or not.
In late cancellation situations, the End Customer is also responsible for contacting the Service Provider directly to settle the situation. In addition to the above late cancellation charges, the End Customer may be charged additional charges relating to the possible deposit as mentioned in section 2.4.
The variations [indicated by the symbol[●] to the Book Salon Terms of Use concern the cancellation policy of each individual Service Provider. End Customers are advised to carefully review the cancellation policy of each Service Provider before booking, as these specific terms may differ. By proceeding to book a Service through the Booking System, End Customers acknowledge and accept the specific cancellation policy of the selected Service Provider, including any variations related to the cancellation timeframe, associated fees as well as the deposit specified in section 2.4 as indicated.
Deposit Policy
In order to secure an appointment for the Services, a deposit may be required from the End Customer at the time of booking. The amount of the deposit will be specified at the time of booking and will be deducted from the final bill after the completion of the Services. The deposit may be paid via credit card, debit card, or any other payment method specified in the Booking System at the time of booking.
The deposit is non-refundable in the event of cancellation by the End Customer.
If the End Customer reschedules the appointment with more than [●] hours' notice, the deposit can be transferred to the new appointment depending on the Service Provider's policies.
If the End Customer does not arrive to the booked appointment without cancelling, the Service Provider will withhold the deposit, and additional charges might be charged from the End Customer if the deposit does not fully cover the late cancellation fee as defined in section 2.3.
If the End Customer has given a deposit for the booked Service and the Service Provider is unable to provide the booked Service for some reason, the End Customer is responsible for contacting the Service Provider directly to settle the situation. Alternatively, if the End Customer cannot contact the Service Provider, the End Customer may contact Book Salon by email to support@booksalon.com.
Late Arrivals
In order to ensure that the Service Provider can provide the best service to all their customers, the Service Provider has the right to shorten or reschedule the booked appointment and charge an additional fee, if the End Customer is more than 15 minutes late.
The End Customer is also responsible for contacting the Service Provider directly if the End Customer notices that he/she will be late for the booked appointment.
Refund Policy and Reclamation
All sales for Services are final and non-refundable unless otherwise stated in these Terms or separately agreed between the End Customer and Service Provider.
If the End Customer is not satisfied with the provided Service, the End Customer should contact the Service Provider directly within 48 hours from the booked appointment and the Service Provider will do their best to solve the situation in accordance with the Service Provider’s policies.
Prices and Services
The Services offered by the Service Providers and their prices are visible in the Booking System. The Services and their prices are subject to change without notice. Book Salon will do its best to keep the Booking System and the End Customers up to date on any changes that may occur. The Service Provider has right to change the booked Service to another more suitable Service if the Service Provider considers that the booked Service is not suitable for the End Customer (for example, the End Customer has booked a haircut for short hair, but the End Customer actually has long hair.).
Misuse of the Booking System
If the End Customer repeatedly cancels, reschedules or does not show up at all, the Service Provider has the right to require that such End Customer pays the full amount of the Service in advance at the time of booking.
If the misuse of the Booking System continues, the Service Provider may prevent the End Customer from booking their Services through the Booking System. In this case, the End Customer may contact the Service Provider directly and ask for available Service times.
Rights and Obligations
The Service Provider's obligation is to provide the Service recorded in the End Customer's booking confirmation at the time recorded in the booking confirmation. The End Customer and Service Provider acknowledge and agree that Book Salon does not itself provide the Services recorded in the booking confirmation but only mediates them through the Booking System. The Services recorded in the booking confirmation are provided independently by the Service Providers listed in the Booking System, who adhere to local laws, their own delivery terms, and other regulations applicable to them.
Book Salon is not responsible for the quality of the Service, its performance time, conditions, or damages incurred during the performance of the Service. The End Customer acknowledges and agrees that the Service Provider listed in the booking confirmation is responsible for the performance of Service.
By using the Booking System, the End Customer agrees to release Book Salon from any claims, demands, damages, or any other legal actions or proceedings of any kind arising out of or connected with such disputes.
The End Customer is responsible for ensuring that they collect all their personal belongings before leaving the Service Providers’ premises, as Book Salon is not responsible for any lost items.
Book Salon has the right to use and convey the information presented by the End Customer to the Service Provider to the extent necessary for the Service Provider to provide the Services booked by the End Customer.
Book Salon and the Service Provider have the right to use the End Customer's information to send news related to the Booking System, notifications of discounts, and other information to the End Customer if the End Customer has given permission in the Booking System.
The Service Provider and End Customer are responsible for ensuring that any information or material uploaded to the Booking System does not infringe the intellectual property rights or other legal or contractual rights of any third party. Book Salon has the right to modify the Service Providers and the End Customer’s data if they contain unlawful, unpublishable, offensive or incorrect information.
Limitation of liability
Book Salon, the End Customer and Service Provider are liable for any material failure or deficiency in fulfilling own obligations under the laws of Finland or the local mandatory law of the country in which the Service Provider from which the service was booked is located if the choice of law is not permitted as specified in section 7. Any such local mandatory laws only prevail laws of Finland in the minimum mandatory extent applicable.
Due to the nature of the Booking System being internet-based, Book Salon provides the Booking System as it is and shall not be responsible for the faultless operation of the Booking System or that the Booking System would operate without any interruptions or that Booking System is free from malware, viruses or other harmful features. Book Salon shall not be responsible for any technical faults, interruptions caused by maintenance or installation operations, or data transmission problems, disruptions or interruptions caused by third parties.
The End Customer or Service Provider are not entitled to claim damages for delay or defect from Book Salon if the damage is beyond Book Salon's control and Book Salon could not reasonably have been expected to take the event into account, or the consequences of which Book Salon could not reasonably have avoided or overcome.
Book Salon uses reasonable efforts to protect the information that the End Customer or Service Provider submits to the Booking System. However, the End Customer and Service Provider acknowledges and agrees that any transmission of their information is at their own risk. Book Salon shall not be liable towards the End Customer or Service Provider for any indirect, consequential, or special damages arising under or in connection with the Terms.
Book Salon’s maximum liability for any damage to the End Customer under these Terms or arising from the use of the Booking System is limited to the value of each paid Service and in any situation Book Salon’s liability does not exceed 500 euros.
Book Salon’s maximum liability for any damage to the Service Provider under these Terms or arising from the use of the Booking System is limited to the value of 15% of the total amount of any fees paid by the Service Provider to Book Salon during the 12-month period preceding the event giving rise to the claim.
Privacy Policy
Book Salon and Service Provider complies with all the applicable requirements of the applicable data protection legislation when processing personal data of the End Customers. Any personal information submitted by the End Customer will be used in accordance with Book Salon’s Privacy Policy. By using the Booking System, the End Customer agrees to Book Salon’s Privacy Policy.
Force Majeure
Book Salon is not liable to the End Customer in situations where it is prevented from fulfilling its obligations due to reasons independent of Book Salon, which it could not have reasonably foreseen, and the consequences of which it could not have reasonably avoided or rectified, such as a natural disaster, thunderstorm, power outage, strike, war or fire, new or amended law or regulatory provision, telephone or telecommunications fault. Force majeure event also includes any unforeseen event by a third party or the Service Provider, such as a banking system malfunction.
Governing Law and dispute resolution
These Terms shall be governed by and construed in accordance with the laws of Finland provided that there are no mandatory provisions concerning the choice of law in the legislation of the country in which the Service Provider from which the service was booked is located. The End Customer, who is a consumer, always has the applicable mandatory rights under local consumer protection law, regardless of these Terms. Any such local mandatory laws only prevail laws of Finland in the minimum mandatory extent applicable.
Any dispute, controversy or claim arising out of or relating to the use of the Booking System shall be subject to and settled in the jurisdiction of the courts of Finland provided that the legislation of the country in which the Service Provider from which the service was booked is located does not include mandatory provisions concerning the choice of jurisdiction. Any such local mandatory laws only prevail laws of Finland in the minimum mandatory extent applicable.
